Overview

Ferry Merchandising LLC (“Ferry,” “we,” “us,” or “our”) operates this store and website and provides its information, products, tools, and related services (the “Services”). Shopify powers the Services. These Terms of Service (“Terms”) and the policies linked on the store govern your use of the Services.

By using or purchasing through the Services, you agree to these Terms and our Privacy Policy. Initial public sales and delivery are limited to the United States. Ferry manages and supports merchandise programs featured for partner businesses; featured partners are not responsible for routine order support, production, shipping, replacements, or refunds.

Eligibility and accounts

You must be at least the age of majority in your state of residence. You are responsible for accurate account and order information, account security, and authorized use of your payment method.

Products, orders, and payment

We make reasonable efforts to display products, colors, sizes, images, and prices accurately, but displays and made-to-order production can vary. Products may be changed, limited, or discontinued. By ordering, you confirm that the order and delivery information are accurate, the payment method is authorized, and you had access to these Terms and the store’s policies. Prices, taxes, and shipping charges shown at checkout apply.

We may correct errors or cancel and refund orders affected by suspected fraud, unlawful activity, an obvious pricing or product error, product unavailability, or a legal restriction. Orders enter production quickly, so changes and cancellations are not guaranteed. See our Return and Refund Policy.

Shipping and delivery

Production and delivery times are estimates, not guarantees. Carrier delays, holidays, product availability, address problems, and events outside Ferry’s control may affect timing. Items may ship separately. Ferry will handle qualifying lost-shipment reports as described in our Shipping Policy and Return and Refund Policy. Nothing limits customer rights that cannot be waived by law.

Intellectual property

The Services and their text, graphics, designs, artwork, logos, photographs, product presentations, software, and other content are owned by Ferry, featured partners, Shopify, or their licensors and are protected by law. You may use the Services only for personal, non-commercial purposes. You may not reproduce, distribute, modify, sell, exploit, or create derivative works from protected content without the applicable owner’s written permission.

Third-party services and privacy

The Services may include third-party tools, links, integrations, payment providers, fulfillment providers, shipping carriers, analytics, or communications providers. Their services are subject to their own terms and policies. Shopify powers the Services, but purchases through this store are transactions with Ferry. Our handling of personal information is described in our Privacy Policy.

Prohibited uses

You may not use the Services to violate law or third-party rights; infringe intellectual property; harass, threaten, defame, or impersonate others; transmit deceptive or harmful content; introduce malware; collect personal information unlawfully; send spam; interfere with security or access controls; scrape or exploit the Services without authorization; or circumvent protective measures. We may suspend access for violations.

Errors, warranties, and liability

We may correct errors in product descriptions, prices, promotions, shipping charges, timing, or availability and cancel or update affected orders, with refunds when required. To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” except for express promises in an applicable listing or policy. We do not warrant uninterrupted, timely, secure, or error-free access.

To the fullest extent permitted by law, Ferry, its featured partners, and their affiliates, officers, employees, agents, contractors, licensors, and service providers are not liable for indirect, incidental, punitive, special, or consequential damages, lost profits, revenue, savings, or data arising from the Services or products. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

Indemnification

To the extent permitted by law, you agree to indemnify Ferry, Shopify, featured partners, and their respective affiliates and service providers from third-party claims and reasonable expenses arising from your material breach of these Terms, violation of law, infringement of rights, or misuse of the Services.

Legal terms

If a provision is unenforceable, it will be severed without affecting the rest. Failure to enforce a provision is not a waiver. These Terms and incorporated policies are the entire agreement regarding the Services. They are governed by Massachusetts law, without regard to conflict-of-law principles. Subject to non-waivable consumer rights, disputes will be brought in courts serving Boston, Massachusetts.

We may update these Terms for operational, legal, or regulatory reasons. The current version will be posted here, and material changes will be communicated when required by law.
